Macron in EU Parliament Focuses on Citizens' Debates before 2019

*Strasbourg/Angelo Marcopolo/- Half of French President Emmanuel Macron's EU Parliament's Speech, and Most of his Total Speaking Time here, this Morning, here, were surprizingly Focused, from the outset, to the Need to Strengthen European Democracy, particularly by vivid Public Debates before important Decisions, involving MEPs but also affected EU Citizens, near to "Eurofora"s Project...


The Other Half was dedicated to another Topical Need : That of Strengthening Europe's Sovereignity, from manifold points of view : Migration, Taxes on Global Web Players, Strengthen €uroArea, Naturally Security and Defence, but also Trade, Climat, Energy, Food, Digital Technologies, and Social Rights.

Macron explicitly prefered to "Exchange Views" with MEPs, since "Programs and Proposals" for Europe's foreseable Future "have already been made earlier", mainly at his landmark "Sorbonne speech" in Paris, as he reminded.

And because, "Today, it seems Necessary to give Time for Exchanges", the new French President stressed, pointing also to the Exceptional Fact that, Later-on this Day, he is going to Launch the 1st Citizens' Consultation, among a 6 Months-long Series, between April and November 2018, Starting by nearby Epinal City, at the Heights of Vosges' Mountains (See : ....).

=> "At this Moment", "our Discussions canNot be just Ordinary", he Warned, Because "it's a Special Context", where "Divisions provoke Doubts aboiut Europe", and certain "Great Challenges (as on Migration, Digital Technologies, Climate, etc) provoke Fears to some People", while we are also Shortly before the 2019 EU Elections, with Political Struggles on Ideas which Forge us", as he pointed out. Therefore, "our Responsibility is even Greater", Macron Warned.

- F.ex., "How could we be Satisfied of such EU Elections where Less than 1 Citizen out of 2 accepts to Go Vote ?", he Denounced, as far as the Post-1999 growing Electoral Abstention is concerned.


- "Today, we canNot just do as we used to do Yesterday", (i.e. Refuse to Speak, ...Share the Top Jobs, and Blame Brussels and Strasbourg for everything". Instead, "we have to Build .... the reality of a Structured Debate on (Political) Beliefs and Proposals", Macron incited.


=> "It's for this Purpose, in order to Try and Innovate, that I proposed the (EU) Citizens' Consultations, already from this year (2018)", he explained.


- So, "I will Launch in France, from this very Afternoon, a Frank Debate, Open, Hard, but Necessary, in order to Know what Unites or Separates us, in order to Drop that over-Simplified Alternative between "Yes" and "No", (as in a Hasty Referendum), on an Issue that has Not yet been seriously Examined (Studied)"...


- On the Contrary, "we shall have a Critical Democratic Debate on that Europe which is ours", Macron incited.

*Strasbourg/CoE/Angelo Marcopolo/News-Viewpoint/- Embattled New French President Emmanuel Macron's deep awareness of the Fact that Europe needs, nowadays, to be reVitalized by certain profound and innovative Changes, largely depends, in practice, also by the more or less important Impact that the EU "Citizens' Consultations" (during a 6 Months-Long Series, which Starts Tomorrow, after his EU Parliament's Speech here) may have, or not, particularly throughout all or most of EU Member Countries.


Symbolically  - but also for Practical, Socio-Political Reasons : i.e. for OutReach to the Real People, as his 3 Days-Long Program, through Industries, Tradesmen, Peasants and too often "Forgotten" Rural Populations (a ... Don Trump's/Boby Sander's concept ?) obviously reveals - the Young Top EU Political Leader chose, almost at the Last Minute, the UnExpected, but Spectacular Format of a kind of ... "Long March" on the nearby Vosges' Mountains, (significantly Kick-Starting by a "Social Gaullism" Historic Stronghold, Tomorrow Afternoon at Epinal), for a Political Fight which will be Hard to Win, but Not Impossible.

For this purpose, Macron Surprized, by chosing to Exceptionally Skip a "routine" Press Conference in EU Parliament, and even to Skip the usual "Flat", too confortable, down-town Ground of Strasbourg-"Euro-Metropole" City, in order to Dare Climb up to the Hights of Vosges' Mountains, starting from Epinal's Fortification Walls, still Haunted, according to a Legend, by ...Napoleon's Ghost, amidst "Real People" on the spot, (but also BirthPlace of Emile Durkheim, Founder of modern Sociology), instead of Limiting himself only to a Bunch of "Intermediaries", too used to "haunt", instead, the Local Quarells around some exclusive Invitations after Invitations, to just another Reception after a Reception, as usual...
 

However, it's also true, that the French President could not, no more, neglect at all, the Symbolic Franco-German ReConciliation and Peaceful Cooperation's landmark City of Strasbourg, Host of many and various EU and/or PanEuropean Organisations, (EU Parliament's full weekly plenary sessions, 47-Member Countries strong CoE, the ECHR, EU's Ombudsman, Shenghen system, Euro-Corps Army HQ, "ARTE" EU-RadioTV, and, recently, even of the "1st European University" : See ..., etc).

 

Therefore, an Important group of various Meetings with the European Community of Strasbourg was also Organized, on the occasion of the Official Signature of a New "3 Years-Long" overall Agreement between Strasbourg's Municipality, District, and "Great-East" Region (which has Recently Extended up to Bring closely Together 5 Core European Countries :France, Germany, Switzerland, Luxembourg and Belgium, through their Common Borders, from Strasbourg right to Brussels, through Luxembourg City !), at the Emblematic Location of "Europe's Area" ("Lieu d'Europe"), Facing ECHR, CoE and EU Parliament, while also remaining surrounded by a Luxurious "Green" space, at what had been, once, the Family Home and private Office of the 1st CEO, Director of the City's Modern Newspaper : "The Latest News of Alsace" (DNA).


But, Curiously, it all looks that this was practically organized in a quite Thorny way, particularly from the "Timing" and Transports' point of view, which reportedly Risks to Exclude, in fact, several interested People (even committed and active Pro-Europeans), and an important part of Strasbourg's Journalists from Covering Both the French President's meetings with the City's European Community, at that "Lieu d'Europe" (Comp. Supra), and the Launch of the 1st EU "Citizens' Consultation" at nearby Epinal (Comp. Supra), apparently because of some Tricky and apparently AbNatural Problems of mere Logistics, (which, normaly, should not exist, and were never seen before by "Eurofora" during more than 24 Years of European/PanEuropean/International Press Experience throughout our Continent and even in the USA : +9/1993-2018) !


Indeed, it seems, that, unless to be on board of the Presidential Airplane (where there are only a few seats, mainly for various Officials, etc), People (including even Accredited European Journalists, etc) would be Obliged to "Choose" between having to Leave for Epinal with a Special Bus scheduled Too Early in order to Cover the "Lieu d'Europe" Macron's meetings with the European Community of Strasbourg, and, therefore, Miss it entirely, OR to participate into those Meetings here, and ...practicaly Lose Any real Chance to Arrive at Epinal, for the Launch of the 1st EU "Citizens' Consultation" on Time, (given the Distance, and the Time needed for Ordinary, Public and/or Private Road and/or Rail Transports, compared to the Precise Timing Fixed for those 2, now Competig - instead of Harmoniously Cooperating- Related Events)...


Naturally, "Eurofora" has already been inside a French Presidential Airplane, (together with other Accredited collegue Journalists), but it was, then, in order to Travel some very Long and TransBorder Distances, as, f.ex., between Paris and Berlin, as well as the Other Way round, (with a Natural, Inevitable strong Wish to ...Jump by Parashute while Flying over Strasbourg City, located almost in the Middle of that road !), and NOT just such a Short, Local Distance only Between 2 Villages or Cities practically Located almost inside the Same Geographic Area, and/or in adjacent, Neighbouring Districts, as, f.ex. is the (Comparatively Tiny), much Shorter Distance between Strasbourg and Epinal, (i.e. Alsace and Lorraine), Both touching upon Vosges Mountains' borderline !


Who (and Why) provoked, suddenly, without even any previous Warning, out of the blue, such Exceptional, absolutely UnNecessary, and Strange but Real Logistical Obstacles, (which practicaly Oblige People to ..."Chose" between their Left and Right Hands) ?...

 

And Why Risk to seriously Diminish the overall (and mainly Mediatic + European) Impact that French President Macron's (as well as EU Citizens Consultation's) Ideas and proposals for ReVitalizing Europe could and should have, as well as an adequate Information of EU Citizens, throughout all our Continent ?

*Strasbourg/CoE/Angelo Marcopolo/- Replying to an "Eurofora"s Question, the Leading Experts of a Pioneer EU/CoE's New Joint Program "Digital Resistance", Richard Heise and Bastian Vasen, from the Leibniz University of Hannover (Germany), agreed, in substance, that Internet is not only a vehicle of Challenges, (such as "Fake News", Spying on Personal Data, Bullying, Discrimination, Indoctrination/Manipulation, etc, but Also a potentialy Wonderful Tool Facilitating Verifications, Fack-Checking and Search of Truth, key Discoveries, World-wide Publications, Access to Knowledge, Overcome InEqualities, Fight against Censorship and for Freedom of Expression as well as Press/Medias' Freedom, etc.

Significantly, that Pioneer EU/CoE Project, backed by Teams from 5 Universities accross the EU (Austria, Germany, Italy, Romania and Greece), was officialy introduced during a PanEuropean Conference in the 47 Member Countries strong CoE (including Russia, etc), at the Beginning of EU Parliament's Plenary Session of April 2018 this week in Strasbourg, where MEPs are due to Discuss on Wednesday, April 18, 2018, also Topical Issues on Private/Personal Data Protection and Elections' Manipulation, with EU Commission and EU Council's Representatives, and just at the Eve of new French President Emmanuel Macron's official visit and Speech in EU Parliament, Tomorrow Morning, Tuesday, Aprl 17, before Launching, later-on, during the Afternoon, at the Vosges' Mountains, (See : ...), the 1st EU Citizens' Consultation in a 6 Months-Long Series (April - November 2018) on Europe's Future, (where Web's use was explicitly underlined, in Addition to actual Meetings, also in a Press Briefing organized by the Elysée Palace for Journalists including "Eurofora", during the Week-End).


- Indeed, that Education Project is due to Focus mainly on Young Students "up to 18" Years of Age, while Macron's Citizens Consultations (due to Extend throughout almost All EU Member Countries), reportedly would Start since 16 y.o.

And, even if the Bottom-Line seems still UnClear, as far as Age is concerned, on the contrary, at least one thing is certain : - F.ex., "among by 3 Sons, it's only the Youngest one who is really a fully-fledged "Internet Native !", as told "Eurofora" CoE's Experienced, Education Manager Christopher Reynolds (from the UK), in charge of all "Digital Citizenship Education" projects. Moreover, in fact, Internet Use, Nowadays Starts already from Small Kids of no more than 4 or 5 Years old, even Before they get into mainstream School, added Reynolds...


So that, even if it's true that the CoE had Previously Worked on some kind of "Digital Citizenship" and/or Internet Education projects, (f.ex. alreeady since 2014, etc, as he reminded to "Eurofora"), nevertheless, it's also a Fact that, as, f.ex., EU Commission's Policy and Investment's Strategist, at the Education/Culture DG, colorfully said, Smiling,: - "It's the 1st Time that I come to the COE in Strasbourg for such kind of projets"...


- However, this is Part of a much Wider, and quite Older Category of the PanEuropean Organization's "Cooperation" projects in the Human s"Capacity Building" sector, as the Compoetent CoE's Senior Official, Ms Arzu Burcu Tuner reminded to "Eurofora".


=> Indeed, a Brand New and Extended 2018 Edition of a relavant CoE's older Capacities Toolkit "Box", whose imminent Publication was Announced Today by Reynolds, surprinzingly, got, in just a few Minutes-Time, an overwhelming Majority among the Participants of this Conference from various European Countries, spontaneously Interested to Ask ... where, when and how could they have themselves at least one precious Copy asap !


Reynolds, trying to keep a Solid British "Cool" Temper, (since, anyway, as a CoE's Officer us Not persobally concerned by EU's "BREXIT" Time-Deadline related matters), diplomatically promised to inform all of them asap, but carefully declined to explicitltly name a precise Date/Hour of actual Delivery...

1st EU University aims Integration First but Development can go Fast tell EF French+German Officials

However, it's also a Fact that, at least at First Sight, a Strong Impression results by simply Reading the main Contents of the (Imaginary) Case chosen for 2018's Mock-Legal Proceedings inside the ECHR's great Chamber in Strasbourg, that the "Good" Guys, Obviously, couldn't Stand but Only in Favour of the Complaint lodged by the Whistle-Blower (a Young Woman Civil Servant at a Ministry, Fired, even Striped from her Nationality, and Prosecuted for Treason, etc), against the Government of a State seriously accused to have Ordered Targetted Killings of several Individuals, that some had Tried to timely Denounce in Public, through a Journalist (another Lady), who had, finally, been found Dead, Later-on, in non-elucidated circumstances...


A fortiori when that Complaint (mainly for Violations of the Human Rights to Freedom of Expression, Fair Trial, etc), had been quite Efficiently Presented, by a Team of Young Students of Law from the Angers University, who (by another Striking Coincidence) were All Young Ladies  : i.e. with more than 5 Women for a Total of 5 Persons on the "Good" Side of Supporters of the Truth... (Which, by the way, is also Feminine, as Word, in the Original French Language in which the "Rene Cassin" Annual Competition traditionally takes place, with the Participation of several Dozens of Universities almost from all over Europe and beyond, including this time, f.ex., in addition to Paris, Strasbourg, Grenoble, etc, also Switzerland, Bruges' "College of Europe", Romania, Armenia, the Netherlands/Maastricht, Brussels, Moscow, etc, among the Finalists).

- But, as also the Experienced, former Long-Time CoE's Director-General on Legal and Human Rights issues, Philippe Boillat from Switzerland, (a Member of Today's "Court" in ECHR's main Room), agreed with "Eurofora", it's precisely this rare Overload so Many "Good" Arguments and Noble Values to support, from the Side of that WhistleBlower's Legal Complaint on Basic Human Rights grounds, that might have Incited its Team to Rely, perhaps, too much, on the intrinseque Value of the Content of its Cause, that it looked a little-bit ...Too Calm and almost Sure to Win.


- While, on the Contrary, the obviously too "Hard" job of the Adverse Team : that of the Defenders of the above-mentioned State's Government, who were Obliged to represent, apparently, the "Bad" Guy, (i.e. a Government seriously accused to Order Targetted Killings, and harshly persecutes the WhistleBlower who dares Reveal that Scandal in the Public : Comp. Supra), seems to have kind of ...Stimulated the Other 2 Young Students of Law, (them : All Young Men !), Obliging them to Make much More and Hard Efforts, Struggling with even more Fighting Spirit, etc., in order to Try to Face the Huge Challenge that they were Facing in such a thorny affair...


+ Moreover, they (as Real Human Persons), were ... "Innocent" themselves, since their assigned Role as Legal Defenders of that State, had Not been Freely Chosen, But, on the Contrary, it had been Imposed upon them, "by Drawing Lots", as the Chairwoman of this 2018 "René Cassin" International Competition, Professor in Law, Peggy Ducoulombier, said to "Eurofora".

+ In Addition, the overall Method that had been Chosen by the Organizers this Time (for the 2018 Competition), by Exceptionaly Giving to All the Members of the "Court" to Raise and Ask Questions at Both Sides (Complaint and Defense) at Any Moment they wanted, During this Hearing's Plaidoyeries, (Something which is normaly Excluded at a Real ECHR Hearing, where Euro-Judhes can Ask Questions Only AFTER the End of the Oral Presentations initially Made by the Parties), indeed, considerablly Contributed into Making this Hearing much more "Sharp" than usual, almost Constantly requiring from Both Teams of Young Students of Law to remain at the "Cutting Edge", Ready to React Fast, Right, and Strong...

- From the Side of the Legal Complaint (i.e. speaking for that WhistleBlower), the Obvious Answer was "NO" : F.ex., in such a case, the Defence Minister (accused to Order the Killings) was Out of Question, his Chief of Staff had No real Independence, the Minister of Justice could Not be Trusted to act as he should, and even the Attorney General wasn't really 100% Independent nor fully reliable, (etc). So, it was Just the Press (the Journalist who curiously Died, Shortly Afterwards) that had the Practical Capacity, Independence and Will to Help reveal the Truth to the People.

- But, from the Side of the Legal Defense (i.e. speaking for the respondent State), they were, obviously, Obliged to Strongly Fight Back : It was their Last Chance... Among Many and Various Other Arguments, (more or less unconvincing to "Eurofora"s view), what Singlet out was, particularly, the Reply given as far as it concerned the Possibility to Alert the Attorney General : - Indeed, he would be, in Principle, more Independent than Others, (Comp. Supra), from a fully Hierarchical Subordination, he even had a Legal Duty to act for the General Interest, and, Moreover, he (as a fully-fledged Jurist) would have Certainly taken, at least, the elementary Precaution to Distinguish and CHOOSE, among All those Numerous Data contained in the Papers that the WhistleBlower simply Photo-Copied as such, and Gave to the Press, Only those really Needed in order to Prove the Scandal of those Ordered Killings, while, on the Contrary, Ommitting to make public, i.e. Protecting Any Other Data of Private, Personal or Professional Nature, concerning several Individual Agents of the State, simply Ordered to do this or that, by their Superior (Comp. Supra), as well as any Other Delicate Secret of State, which might, eventually, be Necessary for the National Defense and/or National Security, as well as its Citizens Protection from Terrorism.

+ But, when "Eurofora", shortly Afterwards, discreetly Questioned Both Teams on what they thought about the Real Independence of an Attorney General in such kind of cases, the Reply from the Legal Complaint's side (for the WhistleBlower) Simply was that "it Depends on the National Legislation of Each Country", and that from the Legal Defense (for the respondent State) merely was, in substance : - "But, at least, he is a Magistrate !" I.e., something which, honestly, more or less Deceived us, apparently still Leaving that Question Open to Necessary Debate...

=> What a Surprize, then, when, Shortlty Afterwards, we shaw our Main Interlocutor from the Side of the Winners of this 2018 Contest, i.e. the "Defending" Team, (that of "Jean Monnet" University from Saint-Etienne), a Young Student in Law mysteriously named "Yannis Berthelier" (naturally looks like Franco-Greek, but he Laughed several Times, playing with "No !", when we asked, until a Young Lady who knew him told us that it's rather True..), who Finally Received, Personally, the Greatest Honor, (Officially attributed by the President of the "René Cassin" International Foundation for Human Rights, f. ECHR President, Professor Jean-Paul Costa himself), that of the 2018 Prize "for the Best (Legal) Eloquence"...


The Event (including the Official Distribution of All Other relevant Awards to the recipients : i.e. Winners, Finalists, Team, Participation, etc, including a Weekly Training Invitation at the prestigious French "Conseil d' Etat" in Paris, etc), took place (as it's traditionally used) at the Superbe, Brand New main Room of the "Great East" Region, (Alsace+Lorraine+Champagne+Ardennes), which links, since 2015, Five core European Countries Together, through joint Borders at the historic "Heart" of Europe (France, Germany, Switzerland, Luxembourg and Belgium, timely Facilitating Links between UNO's PanEuropean Headquarters at Geneva, Strasbourg's European Institutions, Luxembourg's EU Court, and Brussels), located Nearby.

+ There, all Participants were warmly Welcomed by the vice-President of that New and Big "Great East" Region, the young Elsa Schalck, Jurist herself, who Linked the European Project with Peace, mainly through Human Rights and Democracy, urged the Young Students in Law to Remember Well what they learned and/or will learn about these Values, when they shall be Called to Use them as Lawyers throughout the Courts, later on, and Concluded with a Balanced Call to Never Forget the Fact that "Human Rights canNot Exist withOut Rule of Law", as she significantly said.

- Elsa Schalck, speaking afterwards to "Eurofora", indeed, Stressed that, as a Lawyer herself, Based in front of the Historic Franco-German Borders near Strasbourg, she Strongly Believed that the appropriate development of a Human Rights/Rule of Law joint Culture and practice, at EU's and €uroArea's Core, including through Training Young Students in Law, i.e. mostly Future Lawyers, etc., has become, Nowadays, really a "must" for all involved in Europe's foreseable Future.

By the way, the Fact that the Annual International "Rene Cassin" Human Rights Competition traditionally takes place, each Year, on a New, but purely "Imaginary" Case, Faithfully and Accurately immitating ECHR's normal Legal Proceedings, (But, naturally, often, "Inspired" by the Actural Reality in Nowadays Society), did Not Hinder, the Experienced former Long-Time Director-General on Legal and Human Rights issues, Philippe Boillat from Switzerland, while Speaking with "Eurofora" and Top Winner Yannis Berthelier (Comp. Supra), etc. to Sincerely Raise a, obviously Capital Question, which was, indeed, always kept in our mind :

People in Europe and the World expect from CoE to make a succes of its "Monitoring" for Human Rights and Democracy, despite difficulties, said Finland's President Tarja Halonen to "EuroFora" at a crucial moment for the mecanism built 15 years ago by the paneuropean organization which celebrates its 60th Anniversary in 2009.

Halonen, known as "Mother" of CoE's "Monitoring" mecanism, a long-time MEP and former Foreign Minister before becoming Finland's President, holds a long experience in the mattter, after also serving twice as CoE and EU Chairwoman in the past. That's why she is well placed to judge how CoE's "monitoring" should deal today with some crucial issues of importance both to CoE and to the EU.

The move came just a Month before a crucial, last visit to Turkey, scheduled for June, by the President of CoE''s "Monitoring" Committee, Ukranian MEP Serge Holovaty, to finalize his Report on Ankara, the CoE Member State with the longest Monitoring procedure. From its results depends its overall credibility.

This is a Test-case, because, in fact, it's in order to avoid Sanctions threatened against Turkey by a CoE's Assembly's April 1995 Resolution for grave Human Rights violations, Democracy gaps, the continuing Military Occupation in Cyprus, the unresolved Kurdish problem, Aegean differend with Greece, etc., that MEPs decided to create, for the 1st time on April 1996, a "Monitoring" proces, allegedly destinated to check, without excluding Countries who did not fulfill all CoE's standards.

In the Past, the obliged withdrawal of Greece's Military regime and of its "Civil" cover-up out of the CoE had helped bring back Democracy in 1974. But, on the contrary, since April 1996, the idea was to "monitor" Human Rights' respect while keeping most concerned Countries inside the CoE. After Turkey's oldest example, this was extended also to several former "Eastern" European Countries, even if CoE's Assembly has imposed to some of them (fex. Ukraine, Russia, etc., after Belarus, Serbia, etc) various "Sanctions", that Ankara always avoided. Curiously more succesful even than .. USA itself, (a CoE "Observer" since 1995), which has been at least threatened with sanctions some years ago..

EU-effects of CoE's Monitoring process became obvious between 2001-2008, since the "closure" of this procedure, when CoE felt that a Country had met most of its Human Rights, Democracy and Rule of Law obligations, (i.e. the "Copenhagen Criteria" for the EU), helped trigger Negotiations with the EU for "Accession" or other closer relations : This occured already before the 2004 and 2007 EU Enlargements to former "Eastern" European Countries, as well as for the commencement of "accession" negotiations with Croatia, and of "open-ended" negotiations with Turkey in 2005.

    But a stricking new development are Holovaty's recent findings that on core Human Rights issues as Torture and Freedom of Expression, Turkey, even "5 Years after" CoE closed its "Monitoring", back in 2004, inciting EU to start accession Negotiations in 2005, still presents grave problems.

    His findings are of crucial importance after a 2008 CoE Resolution called, "if need be", to "seriously consider the possibility of Re-Opening the Monitoring procedure for Turkey" : A move which might affect Ankara's controversial EU bid, since EU Accession Negotiations are based on the Hypothesis that the Candidate fullfils the "Copenhagen Criteria" (See above)..

    Holovaty expressed his will to check  "Matters still Outstanding" and  those that he "didn't have an opportunity to discuss" at an earlier visit this year, "in order to discuss the more complex issues in greater depth", at his forthcoming New Visit to Ankara, before the December 2009 EU Summit.  This is all based on the 2004 CoE Resolution which stresses that, CoE "will continue.. post-monitoring Dialogue with the Turkish authorities,...in addition to a 12-points list,..and on any Other Matter that might arise in connection with Turkey’s Obligations as a CoE member state".

    CoE's Resolution also asks  from Turkey "to secure the proper Implementation of Judgements, particularly in the Cyprus v. Turkey InterState case", of 2001, which concerns also the plight of many Hundreds of MISSING People. It adds Turkey's obligations to "execute" ECHR's Judgements in the Loizidou case,..and in particular adopt General Measures to avoid repetition or continuation of Violations found by the Court" to the detriment of Refugees.

    Nevertheless, Holovaty said to "EuroFora" that "MISSING" persons,"might be included" and cannot be excluded, but he has yet to examine the situation "to find out  which issues will be raised" to the Turkish Government.

    Therefore, "EuroFora" asked Halonen, as the Historic "Mother" of CoE's Monitoring mecanism, if she thought that, "whenever there are grave Human Rights Violations, as fex. "MISSING" persons, attested even by ECHR's judgements, they should be always checked by a Monitoring process. Or could they be forgotten ?"
    
     - "We (CoE) must be, at the same time, Fair, Realistic, but not in the mind that "now we have Forgotten", etc., replied to "EuroFora"'s question Halonen, speaking as a matter of general principle.

    - "When we think of those People that are suffering from the lack of Democracy, of Human Rights, and of the Rule of Law", "we should find a base on how to deal with the (Monitoring) system more rapidly"', she stressed.

    - "Sometimes it's very difficult to combine Transparency and Effectivenes together, particularly in this specific case", she went on to say. But, "I have not found a (CoE Member) Country who could be insensitive in this sens", Halonen answered concerning grave Human Rights violations attested by the ECHR.

    - "I have no ready-made answer. I have the expectations that you, in the CoE, will, step by step, find the different types of the monitoring systems."

    Also "because this is a part of the UN's Post-Conflict system, (fex. when it comes to Cyprus' MISSING persons), and it's a more Global system". So that, "If we make a succes in Europe, the others will follow", throughout the World.  "But they expect that we (Europe) are this opportunity, this Opportunity to make a Succes", Halonen concluded.

    In addition, she advised to extend CoE's Monitoring to all its 47 Member States, "because, as long as we hear that, all these monitoring systems are "OK for the neighbor, but not for me", "it's very difficult" to understand. Something which could make easier to Compare...

    Finnish MEP Jaako Laakso, former CoE Rapporteur on the Occupied Territories of Cyprus and one of the 5 Signatories of the Historic CoE's call to create the "MONITORING" mecanism since 1996, was more specific :  - "We (CoE Assembly) have to find a way for the issue of Cyprus' MISSING People to be better followed", he stressed, anouncing his intention to "speak to Mr. Holovaty" about that. "There might be also other ways", added Laakso.

    - The 2008 "Year had been a very Bad one for Turkey with regard to Human Rights in general, and Freedom of Expression in particular", denounced, meanwhile, Holovaty's preliminary Post-Monitoringh Draft Report by Holovaty, published by the CoE on April 2009.

    "Amnesty International believes that freedom of expression is not guaranteed given the various articles of the Criminal Code that restrict it. .. "For example, 1,300 Websites are said to have been closed down by the (Turkish) authorities in 2008" ! While "the new Turkish Criminal Code was used to bring a total of 1,072 proceedings between June 2005 and April 2008, and led to the conviction of 192 people", for expressing views. "Representatives of the Özgür Gündem newspaper, which specialises in Kurdish affairs, ..complained about Numerous Attacks on their Freedom of Expression ...as was everyone who advocated a settlement to the question by means other than the intervention of the army" "According to their figures, 19 Newspapers had been suspended 43 times between 4 August 2006 and 4 November 2008" !...

    Moreover, on 2008,  CoE's "Ministers adopted its 4rth Resolution on the execution of the judgments of the ECHR, ...and outstanding issues regarding 175 Judgements and decisions relating to Turkey delivered between 1996 and 2008...  concerning Deaths resulting from the excessive use of force by members of the Security forces, the failure to protect the right to life, the DIisappearance and/or death of individuals, Ill-Treatment and the Destruction of property". CoE's " Ministers urged the Turkish authorities ...to ensure that members of Security forces of all ranks can be prosecuted without administrative
authorisation" for "serious crimes". Holovaty reminded.

"Nonetheless", Holovaty heard anew of "Several cases of Violence committed last year (2008) by the (Turkish) security forces". Amnesty International speaks of Many Cases of ill-treatment and Torture in the prisons and by the police". "Including, fex."'the death of Engin Ceber, a young man of 29 who died on October 2008 as a result of the TORTURE allegedly inflicted on him by police officers, prison staff and members of the gendarmerie. He was part of a group of people arrested on September 2008 during a demonstration and Press Conference in Istanbul'. Proceedings against suspects are "on-going" in this case.

- " I therefore noted an Obvious Contradiction between the Government’s stated “zero tolerance” policy.... of Torture and other forms of ill-treatment, and the different testimonies given", denounced CoE's Rapporteur.  Turkish "authorities must make considerable efforts to guarantee that proper investigations are carried out into allegations of abuses by members of the security forces and that perpetrators are effectively punished" "In this respect, I have requested detailed Statistics on the number of Investigations, acquittals and convictions in cases involving allegations of abuse in order to show the positive impact of the measures taken to date", Holovaty said, repeating a permanently unsatisfied CoE's demand to Turkey since a Decade...

    - "The Political Crisis that shook the country in the spring of 2008 highlighted the Weaknesses of the (Turkish) Constitution", which comes from the Military regime of 1982, "and the Urgent Need of Reforms", stressed from the outset CoE's Rapporteur in 2009. In particular, "the ...Democratic functioning of state institutions, including the independence of the judicial system, are crucial", he observes.

    But, "the Electoral  system and the ways in which it is circumvented do not appear to give those elected complete Legitimacy, and tend to pervert the course of direct universal suffrage", denounces Holovaty, observing that, even 5 Years later, Turkey did not yet change the 10% nationwide Threshold for a party to take any seat, which is "far higher" than the "3%" maximum in Europe and already condemned as contrary to European Standards by the CoE.

    + Moreover, EU Parliament's 2009 Report on Turkey, drafted by Dutch MEP Ria Oomen-Ruijten and adopted in Strasbourg on March, expresses "Concern over the Failure of the (Turkish) Judiciary to prosecute cases of Torture and Ill-treatment, the Number of which is Growing". EU also "is concerned about continuing Hostility and Violence against Minorities" in Turkey. It also "calls on the Turkish Government to launch, as a matter of Priority, a Political Initiatve favouring a lasting Settlement of the Kurdish issue, (while "condemning violence.. and terrorist groups"). EU "regrets that No progress has been made on establishing full, systematic Civilian suprevisory functions over the (Turkish) Military".

    The final results of Holovaty's 2nd and last visit to Turkley will be known later this year, and, at any case, before EU's December 2009 Summit.
