CoE Ministerial Committee wins EyeGlasses Award on Police Violence v. demonstrators for Family+Kids

*Strasbourg/June 19+Updated June 20, 2013/- CoE's Committee of Ministers, already widely critisized in the Past for its notorious "Art" in Watering down some among the "Hottest" Political and/or Human Rights issues, has just won a "Special Offer" for "Free EyeGlasses" by "EuroFora"'s readers, after its astonishing Reply to a critical Question by the President of CoE's Parliamentary Assembly's biggest Group, that of ChristianDemocrats/EPP, Italian MEP Luca Volonté about "Police Violence" in an old, big and important CoE Member Country, which hadn't been accustomed to such incidents in Modern Times :
President Volonté had, in substance, clearly asked the Committee :
- "What Measures does (it) intend to take to encourage the (X) Government to bring ...to an End" an "Increasing and Worrying Repression, ...Unacceptable by a Member State of the CoE", to which is subjected "the Social Movement now active in (X) in defence of Families and Children’s Rights, Inter Alia (= among many other cases, also) on the occasion of Very large Demonstrations" ?
(I.e. against a controversial and unpopular, according to all Polls, Measure to impose "Same Sex Mariage" and oblige Children to be submitted to the Authority of Homosexuals even total Strangers to their Natural Family, fearing that this will open a way for even more Worrying Measures against Childrens' Rights and Natural Family such as "Subrogate Mothers", "Medically Assisted Procreations", "In Vitro Fertilisations", massive "Pre-Natal Tests", "Sperm/Ovary Banks", and other instruments risking to bypass Natural Procreation of Human Beings for an Articificial one, inevitably controlled by Technocrats, with obvious Risks for Human Dignity and even all Humankind in the Future).
- ". Evidence of this Repression comes from Many Videos, Photos and Eyewitness accounts", Volonté observed.
- "For Example", he cited, inter alia, a Series of Concrete Facts :
(1) "At the demonstration of 24 March 2013, ....large numbers of People, including some very young Children, Women and Elderly persons, were Unnecessarily subjected to Violence and the use of Gas by the police"
(2) In addition, "People walking along the street are regularly Arrested and penalised simply because they are Wearing a Garment or a badge bearing the Movement’s Logo", (simply showing a Father and a Mother with a small Boy and a Girl), he added.
(3) Moreover, several "Accounts are pouring in of People being Hit by the Police".
(4) "On 19 April, a Priest, who was attempting to protect a Young man, was Thrown to the Ground, Struck and taken into Police Custody", he also denounced.
(5) "On 14 April, Sixty Seven (67) Young People who were taking part in a Peaceful Vigil, (Candles, Silence and Songs), were Arrested and taken into Police Custody", Volonté noted too, citting an obviously Non-Exhaustive List of various such concrete examples, (which could easily be extended until June included)...

In its incredible "Reply", - in fact prepared by someone of its Secretariat for adoption during an exceptionaly Overloaded session today (June 19, as "EuroFora"s previous NewsReports had already guessed : See f.ex. : .......)- , CoE's Committee of Ministers, curiously, ....doesn't even examine anything by its own, ...
contrary to what is normaly its Duty, particularly since the 2005 Warsaw PanEuropean Heads of State/Governent Summit, CoE has officially bee, given an explicit Mandate to focus on Defending and Promoting "Human Rights, Democracy and Rule of Law", (comp. "EuroFora" co-Founders' NewsReports from that Historic event, on the spot, published mainly at "TCWeekly"+)
Instead of doing so, now, CoE's Committee of Ministers astonishingly Limits itself only into merely .. transmitting what it ..."was Informed by the (X) Delegation" of the concerned National Government's agents, as if it server merely as a ....Post-Office :
- "According to the (X) Delegation" of the accused State Authorities, all these various incidents, citted Supra, would have Simply been due only to "a few Hundred Extremists" (sic !), who "were Responsible for matters getting Out of Hand", during one "Demonstration of 24 March 2013",
- Because, on that Day, as the accused National Delegation claims, "the (X) Security Forces had established the Routes and the practical Arrangements with the Organisers ...before the event", but, afterwards, "these ("Extremist" : See Supra) individuals had called on participants Not to follow the Agreed Route, (so that) the Security Forces had intervened to Stop them", as the concerned State's agents reportedly said, without even mentioning the Means used for that purpose...
As simple as that !
+ For the rest, if anyone among the (reportedly Numerous) Victims didn't agree with such a "Rosy" version of the incidents spread now during more than 3 Months, the "all persons are entitled to submit a Complaint, if they consider themselves to have been the victims of police Violence, and to bring proceedings in Court". In this regad, it's just ...."10 or or so Complaints (which) "were lodged after the events of 24 May", (i.e. suddenly introducing a small, irrelevant, piece, taken from another incident, apparently related to the May 26 mass Demonstration...), and "they are currently being examined by the Paris public Prosecutor’s office", as propose the agents of the accused National Governrment, (simply transmitted by the CoE)...
= "At all events", (i.e. even if those Claims are True, or Not), finaly, merely ... Repeating that Same Proposal, in Other Words, CoE's "Committee of Ministers points out that ... everyone within the jurisdiction of a Contracting Party to the European Convention on Human Rights, may lodge an individual Application with the European Court of Human Rights", i.e. at Strasbourg's last instance Court.
But, as it is well known, this (i.e. lodge an Application to the ECHR) can be done "once all domestic remedies have been Exhausted", (i.e. after submitting a Complaint to all levels of National Courts, previously), it reminds.

Last, but perhaps not least, finally, the only "original" point in this CoE's Committee of Ministers Reply is, perhaps, the Strange Fact that, Instead of simply saying that this can be done "Only" after "Exhausting all Domestic Remedies", on the contrary, it curiously chose the word : - "Particularly"...
I.e., as if the politically Highest CoE's body was, maybe, implying that, in such exceptional circiumstances, according to a well known ECHR's case-law in some categories of cases such as in Turkey, concerning f.ex. certain specially Sensitive Affairs (as those concerning the Kurdish issue, complaints for Unfair Trials by State Security Courts, and/or Torture, Killings of Dissidents, etc), one might imagine that a Direct Application to the ECHR in Strasbourg might become necessary and therefore justified, if the National Courts prove to be scandalously Inefficient in order to adequately Protect the Victims on Time, (f.ex. if most National Judges are known to Politically take Sides in favor of the Political Party in Power at a given period of Time, etc),
But, this Exceptional Hypothesis having been noted, it's obvious that, practically 99% of that CoE Committee of Ministes' Reply remains just a mere ... "Copy and Paste" of the Claims advanced by the accused State's agents, without ever taking any Initiative to take by itself a closer look at he Real Situation, with its own eyes....
All can easily imagine how Absurd and Unacceptable might become the situation, if CoE started, f.ex., to ask all Victims, even of the most Serious Political Conflicts, and/or Violations of Human Rights, (f.ex. systematic Violations of Freedom of Expression and/or Abritrary Deprivation of Liberty, Torture/Inhuman Degrading Treatments, Killings, etc), whose cases might be brought before CoE's Committee of Ministers, No to expect to find there any other reply at all, than ... only a Mere Reminder of their Right to apply to the ECHR, as if CoE's Highest Political body would be unable to even Watch and See the Facts by itself !...
If it did, then it might easily find out, f.ex., that there are not only "10" Complaints already lodged to the National Courts, but .. More than one Hundred (+ 100), since, among others, also a Group of Lawyers has just lodged even a Collective Complaint of more than 100 concrete cases at once, of Victims denouncing a Police Violence which, thus, seems widespread.
+ By a Tragic Coincidence, all this having happened almost the Same Days that a Peaceful Young Student Demonstrator, (generally known as "Nicolas B"), was Brutally Arrested, Jailed, and immediately Condemned to more than 2 Months in Prison, (reportedly in circumstances which seem close to an Inhuman and Degrading Treatment according what described his Lawyer, and while even various Odious Threats against his Human Dignity are scandalously spreading at the Internet), without even knowing clearly the Official Reason for which Police arrested him, and a 1st Istance Court condemned him with such an Exceptionaly Heavy and obviously Disproportionate Sentence, that many started to denounce as "a Political attempt to Intimidate" the entire Popular Protest Movement.
Exceptionaly, "EuroFora" ommitted here to even mention the Name of the Country, whose Government is accused by the Popular Values Movement to persecute and intimidate it, simply becase we Love that Country, our Family lives in it, being also half-Nationals, while it has also Traditionally been an Historically important supporter of Human Rights, and a Key, core Country for the edification of Europe : So that, the only Hope is to humbly contribute to Awaken all Honest People's Consciousness inside that Country, in order to urgently pass from a logic of Conflict, to a rationale of Democratic Debate for constructive Solutions, particularly in such sensitive Ethical issues.

It's certainly to Hope that, with some so heavy EyeGlasses, as those of this well deserved "Special Offer" (See Supra), CoE's Committee of Ministers will certainly become soon able to Watch any obviously unecessary, excessive and Disproportionate "Police Violence" against mainly Peaceful Protestors, with its own eyes !...

Swedish Foreign Minister, Carl Bildt, speaking to "EuroFora", denied rumors on Turkey's attempts to avoid an EU check of its obligations on Cyprus on December 2009 by blackmailing Nicosia to either accept any deal with intransigeant Turkish claims contrary to EU values on the island's political issue, or face threats against the territorial integriy of the EU island, semi-occupied by Ankara's army.
On the contrary, the incoming EU President-in-office, speaking exclusively to "EuroFora", promissed that he will act for EU Council's decisions on December 2009 assessment of Turkey's commitments on Cyprus to be kept.
Bildt was asked to react to Cyprus' President Christofias' denunciation, earlier this week, that some want to exert "pressure" on Cyprus in order for Turkey to escape from its obligations.
Avoiding to mention any precise Deadline, Bildt, however, warned about "Consequences" in case of "failure" to reunite Cyprus, but without saying whose responsibility an eventual deadlock might be.
Asked by "EuroFora" if there is a risk for "Turkey's commitments to "be forgotten or downgraded", "despite crystal-clear EU Council decisions and EU Parliament's latest Resolution on the assessment to make at the end of this year on Turkey's obligations", according to rumours that, instead of pressing Turkey, on the contrary, there might be "pressure on Cyprus", even "blackmail", as Media reported and President Christofias denounced this week, Bildt denied :
- "No ! ", he clearly replied.
- On the contrary, invited by "EuroFora", to "reassure that the Swedish EU Presidency (7-12/2009) will keep a fair stance, based on principles", Bildt promised that "we (Swedish EU Presidency) will be very clear on all of the decisions taken by the (EU) Council".
He added, however, that "we have very numerous decisions that have been taken" by EU Council, as if he warned, also, on something else.
- "'I am not aware of any sort of statements coming out today''", Bildt started to say, on our reference to Cyprus' President Christofias" denunciation of Turkish lobby's manoeuvers this week, replying earlier to 'another"EuroFora"'s question during a Press Conference at EU Parliament in Strasbourg.
- '"I know the issues that you' are concerned with'", he added, remembering the statements he gave us when Sweden was chairing the PanEuropean CoE on 2008.
- "But, obviously, .. I think that Cyprus' Peace negotiations are extremenly important".
- And "'I think that we are at a unique moment in History, in the sens that both (Cyprus') President Christofias and Mr. Talat (the Turkish Cypriot leader), are personally convinced of the need to overcome the division".
- "It's 20 Years since the fall of Berlin Wal, but we still have a Capital in Europe (Nicosia) that's divided". ,
- 'I don't that we should loose any time in overcoming that"..
- ''We should be aware of the fact that success will bring great benefits, but failure, will also have major consequences. There will not be Status Quo' " It's a question of seeking a solution, or entering another situation, which is somewhat difficult to see exactly how that could evolve", he warned.
- "That being said, this is a negotiation for Cyprus itself", Bildt admitted.
- ''We (EU) can support, the (EU) Commission primarily, be technically helpful, and then, of course, there is a specific role for the UN, when it comes to the Cyprus' situation".
- "At least so far. It might not be for ever'. Certainly not for ever, but for this period of time", Bildt added, skiping now any reference to concrete threats on UNO's Peace keeping force in face of more than 40.000 Ankara's soldiers, contrary to some Press claims, (See previous NewsReports).
Replying to another "EuroFora"'s Question, if anyone might attempt to "impose a Deadline for the conclusion" of Cyprus' Talks on December 2009, Bildt avoided to speak of any precise Time-frame, and indirectly evoked the fact that 35 Years of Turkish Invasion/Occupation obviously durated too long :
'- "If I was from Cyprus, I would say that the Deadline was Yesterday ! '",
Bildt concluded.
Cyprus' Government Spokesman, Stephanou, reportedly pointed out that "a settlement is possible on December if Turkey changes its stance", accepting a solution for the reunification of the island based on UNO resolutiona and EU principles.

Earlier, EU Chair, Swedish Prime Minister Fredrik Reinfeld, highlighted an "historic opportunity" to "re-Unite" Cyprus according to EU's "basic Values"' (i.e. Human Rights) and 'Rules'", in a last-minute change of his draft speech to EU Parliament in Strasbourg.
The initial Draft spoke only about "healing" the island.
Significantly, Reinfeldt linked Cyprus' reunification with Turkey's obligations to respect EU's "Values" and "follow" EU's "common Rules" :
- What is "called Membership Negotiations" should lead, "at- the end of the day", into "sharing a set of common Basic Values (i.e. Human Rights, Democracy, etc), and following common Rules", stressed Reinfeld from the outset.
- "This is something that those on the Outside (of the EU), are now contemplating", up "to Ankara", for "a solution" on "Cyprus", observed the EU Chairman, immediately afterwards..
- "Both sides of Cyprus have been granted a historic opportunity to together reach an agreement on a solution to re-Unite the island, that has been divided for far too long", said Reinfeldt, modifying his draft text.
- "The Swedish Presidency will act ...in accordance with Commitments EU has made, on the basis of Criteria that apply", "as a Honest Broker", he promised.
- "To those on the inside (of the EU), allowing the membership process to become an opportunity to solve protracted disputes, can be tempting", he added.
"In such cases, we must find solutions that can benefit both sides, and open up a way forward. Otherwise, it would jeopardize the progress we have made towards EU integration", Reinfeldt said.
